Q:  Dear Mr. Reno:

If the carpet in my rental home is 10 yrs old but in good condition, do I have the right to demand our tenants to pay for the replacement of the carpet if they allowed their dog for 2 1/2 yrs to urinate all over it throughout the entire house so much that it went through the padding into the sub flooring? Professional carpet cleaning services said it would be impossible to clean it.

Q: Name one thing property managers wish tenants knew.

A: We don’t make the rules, we’re simply paid to enforce them. Every property manager has encountered that tenant who is disappointed, because the property manager refuses to disobey the terms of the lease to benefit a tenant’s situation. Property managers wish tenants understood that each state has Landlord-Tenant Laws designed to protect the rights of both parties in the lease: the landlord and the tenant. When tenants sign a lease, the terms of the lease are not merely made-up by the property manager, but rather established and enforced by the state’s Landlord-Tenant Laws. The state governs when rent is due, when late fees are assessed and what amount to charge, how much notice to give before moving, a landlord’s and tenant’s responsibilities, among others. The lease constitutes a contract. Good tenants and good landlords respect contracts, and good property managers enforce them.

Q:  Dear Mr. Reno:

It’s a rent control area. My tenant took out my kitchen cabinets and bathroom cabinet and replaced it with smaller one and took out the closet door and put curtain. I took him to court and lost because I didn’t have contract it was dismissed. Then he didn’t pay rent I took him to court and the judge forced me to make him stay and pay because his lawyer filled motion because I didn’t put my address on 3 day notice but I live in same property but different address. He called housing authority and health commissioner because he damaged my shower and cracked the lenolyan tile and broke the wall heater and broke the smoke detector so I fixed all of that. I don’t know what to do with him. He doesn’t want to move. His bringing guests over and telling me “you cannot do anything because no matter what u do I win”.

A: Wow! Where I come from, even with rent control, you’re not obligated to renew a lease. If he’s got one, and now he’s paying, unfortunately, you’re probably stuck with this nightmare until the lease expires.
